Do I need a will if I have young children?

Yes, a will is the only document in Georgia that lets you name a guardian for your minor children; nothing else does this, not even a trust.

At what age should my kids inherit their money?

Under Georgia law, your child inherits everything as soon as they turn 18, with no option for conditions from you. A trust lets you set specific terms, like a specific age when they should inherit, staged distributions, or funds released for milestones like college or a first home.

Do I need a will and a trust, or just one?

Most Georgia parents need both. A trust controls how and when your kids inherit, and helps your estate avoid probate. A will names their guardian and accounts for assets you choose to leave outside the trust.

What happens to my kids if both parents die?

If you don't have a named guardian, a Georgia court will appoint one, typically after a hearing where relatives can petition to be considered. Without written guidance from you, a judge will make that choice, with no record of who you do or don't trust. This is why naming a guardian and standby guardian as part of your estate plan is so important.

What is a standby guardian, and do I need one?

A standby guardian can step in immediately if you're incapacitated or pass away, without waiting on a court hearing to authorize someone to enroll your child in school or approve a doctor's visit. If your children are minors, this is an essential part of your estate plan.

How does the court decide who raises my kids if I don't have a will?

A judge weighs the child's best interest, considering factors like existing relationships, stability, and any relatives who come forward, but there's no guarantee the outcome matches what you would have chosen.

What happens to my kids if I'm hospitalized?

A will only takes effect at death, so it won't help if you're incapacitated. Guardianship documents and powers of attorney let a named person step in immediately, without a judge's involvement.

Should I leave the same amount to all of my kids?

There's no legal requirement to do this, and plenty of thoughtful parents choose not to. For example, if you have a special-needs child, a blended family, or if your adult kids have very different financial circumstances, these can all be good reasons for an unequal plan. What matters more than "equal" is that your family understands your reasoning, instead of being left to guess.

How can I protect my kids from a previous marriage?

Georgia's default inheritance rules and a new spouse's estate plan can unintentionally cut children from a prior marriage out of an inheritance. A properly structured trust can guarantee those children receive what you intend, regardless of what happens in a later marriage.
